Terms and conditions of use

These terms and conditions of use (“Terms”) apply to the use of Company Products (as defined below) organized or hosted by the Company, on Company Websites or on Partner websites, and to the use of Company Websites.

Definitions

The Company: House of Education AB, a Private Limited Liability Company, incorporated under the laws of Sweden under organization number 556763-8951, with registered address at Bondegatan 30, 116 33 Stockholm, Sweden.

Company Website: Any website which is owned and operated by the Company, including www.houseofeducation.com and www.mystudy.fit. The Company reserves the right to amend these terms to include any future websites that the Company may operate at such time.

Partner websites: Websites or other domains, wholly or partially operated by Partners, which host Company Products for which these terms have been incorporated into the use of such Partner websites and to access such Company Products.

Company Products: all quizzes, competitions, challenges, interest enquiries, forms and other products uploaded to a Company Website or Partner websites, with the intention to match one or more individuals with an education or career opportunity – most often (but not always) a Company Product consists of a profile form to be filled in, a series of questions to be answered, and/or potentially a platform where to upload a written statement, a CV or similar information to engage a user’s interest in a certain study or career opportunity..

Partners: customers, universities, companies listing career or study opportunities or other affiliated partners to the Company who have licensed Company Products or bought other marketing services from the Company.

Information about you and your visits to the Company Website or Partner websites

You need to accept these Terms to access and use the Company Products on a Company Website or on our Partner websites.

Copyright

All content included in a Company Website and the Company Products, such as but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software code, is the property of the Company or its suppliers and may not be used in a manner that would breach applicable copyright laws.

Trademarks

The Company’s trademarks, whether registered or unregistered, including but not limited to “House of Education” and “My Study Fit”, may not be used in connection with any product or service that is not owned or operated by the Company, in any manner that is likely to cause confusion among users, or in any manner that disparages or discredits the Company, or in general is in breach of applicable trademark laws. All other trademarks not owned by the Company or its subsidiaries that appear on this site are the property of their respective owners.

Our Liability

The Company Products and Company Websites are provided on an "as is" and "as available" basis. The material and information displayed on Company Products, or Company Websites are provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, the Company hereby expressly excludes:

  1. all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and
  2. any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with a Company Website or Company Product or in connection with the use, inability to use, or results of the use of a Company Website or Company Product, any websites linked to it and any materials posted on it, including, without limitation, any liability for:
    • loss of income or revenue;
    • loss of business;
    • loss of profits or contracts;
    • loss of anticipated savings;
    • loss of data;
    • loss of goodwill;
    • wasted management or office time; and
    • for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

License and Company Website and Company Product Access

The Company grants you a limited, non-exclusive license to access and make personal use of the Company Websites and Company Products and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of the Company. This license does not include any resale or commercial use of Company Websites, Company Products or their contents; any collection and use of any product listings, descriptions, or prices; any derivative use of Company Websites, Company Products or their contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. Company Websites, Company Products or any portion thereof may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of the Company. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Company and our Partners without the Company’s express written consent. You may not use any meta tags or any other "hidden text" utilizing the Company's name or trademarks without the express written consent of the Company. Any unauthorized use terminates the permission to access the Company’s Website or Company Product, and in addition you hereby agree to indemnify the Company for any and all losses (including loss of potential future revenue), damages, costs incurred or other negative consequence arising for the Company from your breach of these Terms.

If you are under the age of 16, you may use our Company Websites or Company Products only with the involvement of a parent or legal guardian, and by accepting these Terms you explicitly confirm that you either are above such age limit or have received such consent.

Content

You may only upload or submit data, content and information so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam”. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of intellectual property, personal information, or other content. If you do post content or submit material, including any content submitted via Company Products, and unless we indicate otherwise, you grant the Company a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify and hold harmless the Company and its Partners for and against all claims resulting from the content you supply through a Company Website or Company Product.

Applicable Law

By accepting these Terms, you agree that the laws of Sweden, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and the Company. Any dispute shall be submitted to the courts of Sweden.

Change of Control

If the Company engages in a merger, acquisition, bankruptcy, dissolution, reorganization sale of some or all of the Company’s assets or stock, financing, public offering of securities, a similar transaction or proceeding, or steps in contemplation of such activities (e.g. due diligence), some or all information that the Company has collected from the users on behalf of Partners, including personal data, may be shared of transferred, subject to standard confidentiality arrangements.

Website Policies, Modification, and Severability

Please review our other policies, such as Company Product specific rules or additional terms of use that may be posted on Partner websites or on this Company Website and which may further govern your access to this Company Website and Company Product. We reserve the right to make changes to our policies, and to these Terms at any time by uploading them on the Company Website. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms.

Aggregate Information About Users on Company Websites and Company Products

We gather information and statistics collectively about all users of Company Websites and Company Products worldwide, for example, from which area users access most frequently and which services users access the most. We only use such data in aggregate and anonymized form. This information helps us determine what further development work could be most beneficial for our users and how we can continually improve our online services to create a better overall experience for our users. It also allows us to populate Company Websites with more relevant content and Company Products that our users may be interested in. We may also publish some of this information, such as but not limited to the total number of users from different regions of the world, for marketing purposes.

Data Protection Related to Company Products

Any personal data collected by us via a Company Product will be processed by us on behalf of our Partner in our capacity as data processor. As the Partner is the data controller for the personal data, any such processing will be submitted to the Partner’s privacy policy. If you send us a request related to your personal data, we will forward such a request to the relevant Partner who is responsible for handling the inquiry.
